1.- Legal Information and Acceptance

2.- Intellectual and Industrial Property

All content of the Portal—including, but not limited to, texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as the graphic design and source codes (hereinafter, the ‘Content’)—is the intellectual property of The Dental Sleep Center or third parties. No rights of exploitation recognized by current intellectual property regulations are transferred to the User, except those strictly necessary for the use of the Portal.

Trademarks, trade names, or distinctive signs are the property of The Dental Sleep Center or third parties, and access to the Portal does not grant any rights over such trademarks, trade names, and/or distinctive signs.

The use of any wordmark, graphic mark, mixed mark, or any other distinctive sign of The Dental Sleep Center within the sender’s website is prohibited, except in cases permitted by law or expressly authorized by The Dental Sleep Center, and only when a direct link to the Portal is established as set out in this clause.

3.- Terms of Use of the Portal

The User agrees to use the Portal correctly, in accordance with the law and this Legal Notice, as well as any other conditions, regulations, and instructions that may apply in accordance with Clause 1. The User shall be liable to The Dental Sleep Center or third parties for any damages that may result from non-compliance with this obligation.

The use of the Portal for purposes that are harmful to the assets or interests of The Dental Sleep Center or third parties is expressly prohibited, as is any use that overloads, damages, or disables networks, servers, and other computer hardware or software products and applications of The Dental Sleep Center or third parties.

Under no circumstances shall it be stated on the website where the link is placed that The Dental Sleep Center has given consent for the link to be inserted or that it otherwise sponsors, collaborates, verifies, or supervises the sender’s services.

4.- Exclusion of Liability

To the extent permitted by law, The Dental Sleep Center shall not be liable for:

a) Errors or omissions in the content;
b) Lack of availability of the website; or
c) The transmission of malicious programs in the content, despite having taken all necessary technological measures to prevent this.

7.- Reporting Unlawful and Inappropriate Activities

If the User or any other internet user becomes aware that the Linked Sites lead to pages whose content or services are illegal, harmful, defamatory, violent, or contrary to morality, they may contact The Dental Sleep Center, providing the following information:

• Personal details of the reporter: name, address, phone number, and email address;
• Description of the facts revealing the unlawful or inappropriate nature of the Linked Site;
• In the event of a rights violation, such as intellectual or industrial property rights, the personal data of the infringed rights holder if different from the reporter. Additionally, the reporter must provide proof of ownership of the rights and, where applicable, proof of representation to act on behalf of the rights holder when different from the reporter;
• An express declaration stating that the information contained in the claim is accurate.

8.- Governing Law and Jurisdiction

This Legal Notice is governed in all respects by Spanish law. Whenever the applicable law permits the waiver of the established legal jurisdiction, the parties agree that the courts and tribunals of Clare shall have jurisdiction to resolve any disputes.
